What’s Required
To keep things clear and consistent, all merchants are expected to follow these rules:
Sell Only Original or Authorized Work
- All products offered at Belleville Market must be either:
- The merchant’s own original creation, not based on or derived from another company’s trademarked material, or
- Properly licensed, authorized, or permitted for sale (with written proof available upon request).
Merchandise that incorporates or closely resembles the names, logos, slogans, packaging, characters, uniforms, or other recognizable elements of a third-party brand, business, sports team, university, entertainer, television show, movie, or other protected intellectual property is generally not permitted unless the merchant has the necessary rights or written authorization to use that material. This includes handmade, embroidered, engraved, laser-cut, printed, or otherwise customized products. Creating an item by hand does not, by itself, grant permission to use another party's intellectual property.
Provide Proof of Authorization When Requested
- If your products include any third-party logos, names, phrases, team slogans, or other intellectual property, Belleville Market may request documentation showing your legal right to use and sell those products.
- This proof could include a license agreement, written permission, or reseller authorization.
- Merchants must provide this documentation promptly when requested.
- Failure to provide proof may result in products being removed from sale until compliance is verified.
Removal of Unauthorized Products
Belleville Market reserves the right to remove, suspend the sale of, or require the immediate removal of any merchandise that, in its sole discretion, appears to violate this policy or may infringe upon the intellectual property rights of another party. If requested, merchants must remove the affected merchandise from their display within 48 hours. Merchandise may not be returned to the sales floor until the merchant has provided documentation demonstrating that the product complies with this policy. Repeated violations of this policy or failure to comply with removal requests may result in additional corrective action, including suspension of selling privileges or termination of the Merchant Agreement.
Merchant Responsibility
- Each merchant is solely responsible for ensuring that the products they offer for sale comply with all applicable intellectual property laws. Any claims, damages, costs, attorney's fees, or liabilities arising from the sale of unauthorized or infringing merchandise are the sole responsibility of the merchant. Merchants agree to indemnify and hold Belleville Market harmless from any such claims to the fullest extent permitted by law.
